黄子韬胜诉 SM专属经纪权诉讼被法院驳回

2015年9月，SM公司起诉黄子韬在中国的演艺行为侵犯了其“专属经纪权”，但北京市东城区人民法院于上个月驳回了SM的诉讼，认为SM的主张没有法律依据。黄子韬方律师表示，黄子韬在中国开展演艺事业，是基于他本身带有人身属性的权利，如姓名权、肖像权包括自身才艺的展示权等这些应该是艺人本身固有权利，不存在被他人专属的概念，此次法院裁定也印证这一点，SM公司应是意图通过法律手段来制造纠纷，以此损害黄子韬声誉，阻扰其演艺事业发展。

　　随后黄子韬工作室发表长声明称鉴于SM声明充斥着不实信息，为澄清事实，维护黄子韬的名誉，黄子韬工作室现发表声明如下：

　　1. SM公司与黄子韬签订《专属合同》后，疏于提供基本的生活保障，导致黄子韬因工受伤后迟迟未愈。此外，SM公司还存在区别对待中韩艺人等诸多行为。前述种种行为对黄子韬造成了严重的精神压力和身体损害。但在这种情况下黄子韬仍寄希望于能够继续与SM进行合作，多次向SM提出其遭受的不公待遇，希望能够得到改善，SM却均未理会。黄子韬受伤回国治疗至今期间，其本人及其父亲与SM谈判多达八次有余，SM提出和解方案苛刻且要求黄子韬不能更改的直接签署。由此可见SM对于和解一事的诚意明显不足，黄子韬在整个事件中也感到极为不受尊重。

　　鉴于此，黄子韬已在韩国提起了“确认专属合同效力不存在”的诉讼，2015年8月24日，韩国首尔中央地方法院已正式受理此案。总之，黄子韬本次在韩国提起该起诉讼，实为无法忍受上述情形后不得已而为之。

　　2. SM公司在声明中夸大事实，将黄子韬与其之间的民事合约纠纷上升到阻碍中韩两国文化交流的层面，意图通过此种道德批判方式，以断送黄子韬未来的演艺生涯。对此，本工作室深感遗憾。根据合同相对性原则，黄子韬与SM公司之间的合同纠纷不应涉及第三方，也不会有任何结果，SM公司滥用诉权的做法不利于妥善解决双方之间的分歧。并且，按照专属合同的约定，相关争议应在韩国解决，SM在中国起诉的方式不符合双方的管辖约定。

　　综上，为避免SM公司的一方言论混淆视听，本工作室特此针对SM声明作出如上回应。对于未来任何机构的声明或报道，如涉及侵犯黄子韬的名誉权，我方将委托律师采取相应法律手段维护合法权益。

　　黄子韬与SM调解失败？回应：韩媒体消息有误

　　10月4日，有韩国媒体曝出首尔中央地方法院民事和解42部于9月28日对黄子韬与SM的“专属合约无效的确认”民事诉讼进行了调解且以调解失败告终”。报道中称，黄子韬方辩护人主张“专属合约存在不公正性”，而SM则表示“专属合约没有任何问题，是根据韩国公平交易委员会提供的‘标准交易合约书’为基准拟定的”。
